DLBP resolves complex planning matter by addressing design-related reason for refusal at appeal

DLBP is delighted to have assisted a private client by resolving a complex matter regarding the part extension, part replacement to the roof of their home in Hornchurch, London.

DLBP was first approached by our client following them having extended the roof of their home to create an additional bedroom and bathroom – works which fell under Permitted Development Rights.  Due to poor condition of the existing roof however, our client also replaced this to improve its safety and thermal efficiency – works which constitute development and so require planning permission.  DLBP therefore advised our client to seek retrospective permission for these changes and acted on their behalf as agent in doing so.

Despite the Council accepting the works to not be harmful to the residential amenity of neighbouring properties, it disappointingly refused the application on design grounds, finding the changes to be harmful to the host property and surrounding area.

Confident the character appraisal we prepared to support the original application robustly demonstrated the works to be entirely acceptable in design, we advised our client to appeal against the Council’s refusal and, again, acted on their behalf as agent in doing so.  This included us preparing a Statement of Case and all necessary forms, reviewing and challenging the Council’s rebuttal, and liaising closely with the Planning Inspectorate through to receiving a decision.

We were therefore thrilled the Planning Inspector agreed with our assessment in allowing the appeal and granting permission for all of the works.
